Terms and Conditions

  1. Purpose Limitation. You agree that the film and/or photography performed under this Permit shall be used solely for the Purpose identified and for no other purpose whatsoever without the prior written consent of the Port Authority.

  2. Time and Safety Conditions. This Permit is subject to the condition that all photography or filming shall be conducted only at such Date and Time identified or under such conditions as may be approved by the WTC Facility Manager or his designee to ensure that the same can be conducted without interfering with the safety or security of the WTC or other activities and operations at the WTC.

  3. Rights and Use Restrictions. You agree that: (a) Your use of the Location is on a non-exclusive basis contemporaneously with use thereof by the general public or other lessees or permittees of the Port Authority or contractors or stakeholders at the WTC; (b) You shall have no right to indicate any sponsorship, endorsement, partnership, connection, or affiliation between You and the Port Authority or between You and the Location / WTC site without the Port Authority’s prior written consent; (c) You shall have no right to exploit the image or likeness of One World Trade Center or the World Trade Center Oculus Transportation Hub; (d) You shall have no right to use or exploit any Port Authority or third party trademarks without such trademark owner’s consent; and (e) You shall not, and shall not purport to authorize others to, affix, produce, display, publish, distribute or sell Your filming or photography made under this Permit in connection with any goods, services or materials for commercial or non-commercial purposes. Failure to comply shall render this Permit null and void, and any further use of the content shall require new licensing agreements and applicable fees prior to any continued or subsequent use. Furthermore, you acknowledge that this Permit provides clearance only for property and intellectual property assets owned or controlled by the Port Authority. Any additional permissions or rights required from other stakeholders, tenants, individuals, or entities not under Port Authority jurisdiction must be obtained directly by You from the appropriate parties.

  4. Security and Liability Disclaimer. You acknowledge that the Port Authority shall have no obligation to keep the Location, or any portion thereof, guarded, attended or patrolled and You further acknowledge that the Port Authority will have no liability of any kind whatsoever for loss, theft or damage of or to any of Your property, equipment or materials for which You are responsible. You agree to remove all property, materials and equipment placed or installed in the Location by You under this Permit immediately upon the expiration or earlier termination of this Permit.

  5.  Compliance Requirements. In addition to these Terms and Condition, You shall (and shall compel Your officers, employees, agents, contractors, guests, invitees and those doing business with You under this permit to) observe and comply with (a) any and all applicable present and future governmental laws, rules, regulations, requirements, orders and directions which may pertain or apply to Your activities under this Permit; (b) the WTC Site Rules and Regulations; (c) WTC security procedures; and (d) any applicable Port Authority insurance requirements.

  6. Termination Rights. This Permit may be terminated by the Port Authority without cause upon one (1) days’ notice; however, the Port Authority may immediately terminate this Permit if You fail to observe or are not in compliance with any of the Terms and Conditions of this Permit. Termination shall not relieve You of any obligations which have accrued on or prior to termination.

  7.  No Assignment Without Consent. You shall not assign this Permit or any of Your rights or obligations under this Permit without the prior written consent of the Port Authority. This Permit shall be binding upon, and/or inure to the benefit of, all Your partners, partnerships, subsidiaries, parent corporations and affiliates, and all their respective predecessors, successors, assigns, heirs, legal representatives, officers, directors, shareholders, agents and employees.

  8.  No Personal Liability. Neither the Commissioners of the Port Authority, nor any officer, agent, or employee thereof, shall be charged personally by You with any liability, or held personally liable to You under any term or provision of this Permit, or because of its execution or attempted execution, or because of any breach, or attempted breach, thereof.

  9. Governing Law and Jurisdiction. This Permit shall be construed in accordance with the laws of the State of New York. You agree that any action at law or equity arising out of this Permit, including to enforce any of the Terms and Conditions of this Permit or to seek a remedy for breach thereof, shall be brought in a court of competent jurisdiction located in the County of New York of the State of New York. You hereby consent to the exercise by the courts of the State of New York of jurisdiction in personam over You with respect to any matter arising out of or in connection with this Permit and waive any objection to such jurisdiction which You might otherwise have; and, if You are a foreign corporation, You hereby appoint the New York Secretary of State as Your agent to accept service of all process in any action or proceeding in any of the courts of the State of New York, and upon whom process may be served with the same effect as personal service within the State of New York upon a domestic corporation of said State. The address to which the Secretary of State shall mail a copy of any process served against the You is the address appearing on Page 1 of this Permit.

  10. Legal Authority to Execute. You represent and warrant that You or the individual executing this Permit on your behalf has full and complete legal authority and capacity to bind You to its Terms and Conditions.

  11. Crediting. In connection with Your use of the photos and/or video taken here under on social media, You agree to complete the following:

    11.a.  Tag World Trade Center Port Authority social media handles in all posts on social media: @explorewtc on instagram.com/explorewtc, @explorewtc on x.com/explorewtc, @explorewtc on facebook.com/explorewtc

    11.b.  Use the Location Tag “The Oculus at the World Trade Center” or “World Trade Center” in all Instagram posts.

    11.c.  In cases where such content is not shared digitally or is published in a format that does not support linking to the World Trade Center website or social media handles, you shall include the following photo credit in a visible location: “Credit: World Trade Center | Port Authority of New York & New Jersey.

  12. Access and Approval of Media. You agree to provide the Port Authority with access to view and download any photos and/or video footage taken under this Permit upon request. Any further use or dissemination of such content, beyond the use specified in this Permit must be reviewed and approved in writing by You prior to any such use by the Port Authority. The Port Authority agrees not to publish, distribute, or repurpose any of the photos or footage captured under this Permit for its own promotional, commercial, or public-facing purposes without receiving prior written clearance from You, the Permittee.
